First Degree Assault

A charge of First Degree Assault will include one of the following:

Intentionally causing serious physical injury to another.
Attempting to cause serious physical injury to another.
 Also, committing an assault with a firearm.

A serious physical injury occurs when the injuries cause a risk of death or permanent damage.

First degree assault is a felony – punishable by up to 25 years in prison.

Second Degree Assault

Second Degree Assault is a step down from First Degree Assault.  This charge usually comes when there is an assault that does not result in serious injury. Generally, this is an unwanted touching of another that could be perceived as offensive or potentially harmful.

Second Degree Assault is a misdemeanor with a maximum sentence of 10 years in prison.

Lastly, an assault perpetrated upon a law enforcement or probation officer will be considered a felony.

Reckless Endangerment

Reckless Endangerment occurs when a person recklessly puts someone at risk of death or seriously physical injury.

The offense of Reckless Endangerment is not an intentional act. Diving off of a stage into a crowd could be considered Reckless Endangerment.

Reckless Endangerment is a misdemeanor.  A person convicted of this is subject to imprisonment not exceeding 5 years or a fine not exceeding $5,000 or both.
